owns a warehouse insured by Lexington Insurance Co. A fire destroyed the building and the property owner filed a claim for insurance payment. Lexington refused to pay, alleging the building owner or its agents intentionally started the fire with the object of recovering the insurance proceeds. However, Lexington paid $530,103.75 to Interfirst Bank which held the mortgage on the building. The payment was made under the insurance policy's standard mortgage clause.

Interfirst Bank then assigned its mortgage to Lexington. Mississippi Lofts sued Lexington for damages for non-payment to the building owner on the insurance policy. Lexington's defense was the building owner or agents set the fire. Lexington then counterclaimed against Mississippi Lofts to compensate for its $530,103.75 payment to Interfirst Bank. The building owner's defense to the counterclaim was Lexington should not have paid the bank so the mortgage assignment to Lexington was invalid.

If you were the judge would you order Lexington Insurance to pay damages to Mississippi Lofts? Or would you order Mississippi Lofts to pay Lexington Insurance on the counterclaim? The judge answered no to both questions. The fire insurance policy provided for payment to the mortgage lender Interfirst Bank in the event a fire destroyed the building. regardless of any culpability of the insured in the loss, the judge explained. This type of provision is called a standard mortgage clause he added. After making the payment to Interfirst Bank, Lexingtor received an assignment of the mortgage, the judge noted.

This follows the general rule that an insurance company is subrogated to the rights of the party receiving the insurance proceeds, he wrote. Therefore, Lexington now stands in the former shoes of the lender, he emphasized, and can potentially foreclose on the property and thereby recoup its payment to the bank. Lexington Insurance is not entitled to a money judgment from Mississippi Lofts for the $530,103.75 paid to Interfirst Bank in addition to its rights received by assignment of the mortgage, the judge ruled. The house already has copper tubing. 1 I know how metals can sometimes react against each other, but what about plastic? Will it be all right at certain points to connect the plastic to the copper? A. Yes. Plastic pipe does not have an adverse effect when used with metal of any kind. However, be sure you learn how to make the connections.

Since you have had some experience with plumbing, you probably know exactly where you can get the information. One thing you will find out is that the nuts on the connections must be tightened gradually over a period of days so not to damage the plastic. Q. When working on a faucet for the sole purpose of changing a washer, is it necessary to turn off the water? A. Yes.

Most sinks have a shutoff valve at the bottom of the fixture. Turning it clockwise will shut off the water. If you can't find the valve, or if there is none, use the main shutoff valve to the house. L' JUNE 13, Q. In warm weather, the toilet tank in our bathroom begins to sweat and drip water all over the floor.

How can this be prevented? A. The condensation that causes the water to drip results from warm, moist air hitting a cold surface. The outside of the tank is cold simply because it is holding cold water. One way to prevent this is to line the inside of the tank with an insulating material, such as foam rubber. The insulation must be cemented with a waterproof adhesive after the tank has been drained.

In some areas, plumbing supply houses or home centers carry special material for lining a tank. A more professional way of eliminating the condensation is to have a plumber install a mixing valve at the tank fixture. This valve permits a small amount of hot water to enter the tank, thus keeping the water lukewarm. The fabric covers that sometimes are used to cover toilet tanks often will prevent the condensation, because the warm, moist air cannot settle on the cold tank. But this does not always work.
