The Department of Health and Human Services (HHS) made a significant announcement on Monday, revealing its intention to potentially cut off federal funding to Harvard University due to what it claims is a failure to address antisemitism occurring on campus. Such a decision could severely impact the university, which holds the title of the oldest and wealthiest institution of higher education in the United States.
HHS has initiated a process for suspension and debarment, which could lead to a loss of both existing federal funding as well as new federal contracts if the university is found to be in violation of required standards. Paula M. Stannard, who heads the Office for Civil Rights (OCR) at HHS, stated that "the referral of Harvard for formal administrative proceedings underscores OCR’s dedication to protecting taxpayer interests and the broader public good." This statement reflects a growing concern among federal authorities regarding compliance with civil rights laws in educational institutions.
Furthermore, Stannard pointed out that Congress has empowered federal agencies to enforce Title VI of the Civil Rights Act, which pertains to discrimination, through rigorous measures that may include cutting off funding or refusing future federal financial support if compliance is not voluntarily met. In this context, Stannard elaborated that Harvard has been made aware of its entitlement to a formal administrative hearing. During this hearing, an impartial HHS administrative law judge will assess whether the university behaved with "deliberate indifference" towards incidents of antisemitic harassment among students. This is a crucial step in determining whether Harvard has failed in its obligations under Title VI.
Harvard has 20 days from the announcement to request such a hearing. The Hill has reached out to the university to gather its perspective on this matter, but no response has been received at the time of reporting.
It's important to note that this referral does not encompass another investigation by HHS, which is scrutinizing allegations of race-based discrimination within the Harvard Law Review.
This recommendation for action against Harvard comes in the wake of a court ruling that directed the Trump administration to restore billions of dollars that had previously been withheld from the institution.
